10 Florida Laws Going into Effect on July 1, 2022

HB 1557 Parental Rights in Education, AKA “Don’t Say Gay” Bill

A law at limits and/or prohibits classroom discussion about sexual orientation or gender identity (See: https://www.flsenate.gov/Session/Bill/2022/1557);

F.S. 316.3045 – Loud Music in Vehicles

A law that will allow police officers to give tickets to drivers playing music that can be heard at 25 feet or more. The law also provides for tickets if the driver is playing music near churches, schools, or hospitals (See: http://www.leg.state.fl.us/statutes/index.cfm?mode=View%20Statutes&SubMenu=1&App_mode=Display_Statute&Search_String=316.3045&URL=0300-0399/0316/Sections/0316.3045.html);

H.B. 5 – Reducing Fetal and Infant Mortality AKA “15 Weeks Abortion Ban”

a law prohibiting physicians from performing an abortion if the gestational age of the fetus is beyond 15 weeks. The following exceptions apply to allowperforming an abortion post 15 weeks (See: https://www.flsenate.gov/Session/Bill/2022/5):

  1. To save the pregnant woman’s life or to avert a serious risk of substantial and irreversible physical impairment of a major bodily function of the pregnant woman (other than a psychological condition); and
  2. The fetus and not achieved viability and the fetus has a fatal abnormality;

HB 105 – Regulation of Smoking by Counties and Municipalities

allows counties and municipalities to restrict smoking within the boundaries of any of the public beaches and public parks they own, except with regard to the smoking of unfiltered cigars (See: https://www.flsenate.gov/Committees/BillSummaries/2022/html/2616);

HB 7 – Individual Freedom

a law that restricts race-related instruction in the workplace and prohibits teachings of systemic racism in Florida’s K-20 public education (See: https://www.flsenate.gov/Committees/BillSummaries/2022/html/2809)

SB 7072 – Social Media Platforms

Prohibits de-platforming a political candidate. (See: https://www.flsenate.gov/Committees/BillSummaries/2021/html/2345 );

HB 529 – Moments of Silence in Public Schools

requires teachers to set aside two minutes daily in first period for a moment of silence in all grades. (See: https://www.flsenate.gov/Committees/BillSummaries/2021/html/2582);

SB 1028 – Fairness in Women’s Sports Act

When determining who should participate in athletic events officials will use the student’s biological sex as on their birth certificate as the student’s “actual” sex. (See: https://www.flsenate.gov/Committees/BillSummaries/2021/html/2575);

SB 148 – Beverage Law

Allows certain food service establishments to sell or deliver certain alcoholic beverages for off-premises consumption under certain circumstances and that certain alcoholic beverages are not considered “open containers” for the purposes of prohibiting the possession of open containers of alcoholic beverages in vehicles (See: https://www.flsenate.gov/Session/Bill/2021/148);

SB 76 – Insurance

Prevents contractors from soliciting residential property owners through certain advertisements or to make homeowners file insurance claims (See: https://www.flsenate.gov/Committees/BillSummaries/2021/html/2528).
